Considers the case "RJT Consulting Engineers Ltd v DM Engineering (NI) Ltd" TCC, 9 May 2001, which examined whether oral contracts may be subject to the provisions of the Housing Grants, Construction and Regeneration Act 1996. An oral agreement was made between DM and RJT but when a dispute arose over the performance of the agreement and DM began adjudication, RJT argued that the oral engagment was not an agreement in writing for the purposes of the act. The declaration sought by RJT was refused on the grounds that there was evidence that supported the existence of the agreement, such as invoices and minutes of meetings, which would be sufficient to bring the agreement within the ambit of the act.
