The Lord Chancellor's Department (LCD) is seeking to modify distress to bring it in line with the European Convention on Human Rights. The LCD is proposing to abolish distress in the residential sector, and modify it in the commercial sector. It recognises that the commercial property world relies heavily on distress to recover rent arrears. Sets out, and discusses, the main features of the LCD's consultation paper on commercial property distress. Suggests that the proposed modifications risk making the remedy of distress unworkable.
