A recent case, "H R L Property Management Services Ltd v Chequers of Kensington Ltd", involved a dispute over agents' fees where the court ruled in favour of the second agent. The issue raised is not who was first but who was the effective cause in selling the property. The implication is that being first may raise an inference but it is not conclusive.
