Argues that current legislation is unequal to the problems of defective housing. Through discussion of case law illustrates that the Environmental Protectiion Act 1990 s79 has limited application in tackling the problems of poor housing. It does not cover premises that are inherently dangerous, or unhygienic, or lack a facility that would enable the occupants to avoid a risk to health. Discusses the proposals contained in the Law Commission's 1992 consultation paper, "Landlord and Tenant: Responsibility for State and Condition of Property, No 123", and its 1996 report "Landlord and Tenant: Responsibility for State and Condition of Property, No 238". Argues that these proposals should be implemented, but recognises there is no sign of them becoming law in the foreseeable future.
