Representatives from the house building industry including the National Housing Federation have attacked the landmark High Court Decision "Barnet LBC v SoS Environment and McCarthy & Stone (Developments) Ltd"QBD 23 August 2001 which quashed the planning inspectorαs decision that a sheltered housing development site would not be economically viable if the developer was required to include affordable housing on the grounds that the evidence before him showed that the inclusion of affordable housing was viable.
