Argues that the payment provisions introduced by the Construction Act 1996 are confusing to practictoners. Points a number of discrepancies regarding payment in construction contracts such as the 'due date for payment', the mandatory notice, the 'withholding notice', the idea of a 'final date for payment', and the supposedly strict regime for payments. Concludes that the current payment arrangements must be revised so practioners know what they are doing.
