Examines the legislation and guidance governing the control of odour emissons. Explains the law under the Environmental Protection Act 1990 and looks at the SoS guidance on the use of odour boundary conditions (OBC). Discusses the case, "R (on the application of United Kingdom Renderers Association Ltd and another) v SoS Environment, in which the claimants contended that the OBC guidance was incompatible with the Environmental Protection Act 1990 s7(2) and the BATNEEC principle. It was found that the OBC guidance was not incompatible with either.
