QBD 12 July 2001. Appeal by the landlord (S) from a decision of the North West Rent Assessment Committee by which the committee determined a fair rent for the respondent's flat of £624.50 after it had applied the provisions of the Rent Acts (Maximum Fair Rent) Order 1999. The committee certified that but for the cap it would have determined a fair rent of £950 per quarter. The committee's determination of a fair rent had regard to rents of assured tenancies in the same building, but made a deduction of one-twelfth in respect of voids. S appealed that decision. "Held", the appeal was allowed in part and the recision remitted.
