In eight conjoined cases in "Royal Bank of Scotland plc v Etridge" (2001) the House of Lords has set down guidelines to solicitors and banks advising wives who stand as surety for their husband's debts. The steps are to be followed in every case in which the relationship between the surety and the debtor is non-commercial, or where a private individual offers their property to another as collateral for the other's debt. The article lists the steps that the lender must follow and also the solicitor's duty.
