"Burman v Mount Cook Land Ltd", CA 20 November 2001. Examines the right of a tenant to acquire a new lease under the provisions of the Leasehold Reform Housing and Development Act 1993. Tenant (B) appealed against a decision that a notice from landlord (M) refusing B's proposed premium was a valid counternotice. B appealed. Appeal allowed as the counternotice did not comply with s45(2)(b) of the 1993 Act and was therefore invalid.
