"Whitgift Homes and others v Stocks and others", CA 21 November 2001. Defendant (W) appealed against HC decision enforcing restrictive covenants on the grounds that mutually enforceable covenants were annexed to the land. CA upheld the annexation issue but ruled that that building scheme did not apply to the whole estate. Appeal allowed in part.
