Argues that the wording in the Construction Act 1996 that says when buildings or building works do not 'form part of the land' none of the payment or adjudication provisions apply, is unclear and confusing to construction workers. Refers to the case "Gibson Lea Retail Interiors v Makro Self Service Wholesalers" in which the shop fittings were outside the act even though they were supplied and fixed.
