The Office of Fair Trading has recently published guidance on the Unfair Terms in Consumer Contract Regulations to the private rented sector. Since the 1 July 1995 these regulations have applied to residential tenancy agreements and a term fails the test of good faith it causes an imbalance in parties rights to the deteriment of the consumer. In future, landlords, agents and lawyers will not only have to avoid excessive legalise in their agreements but it seems that an absolute ban on subletting fixed term tenancies will be regarded as unfair. Much changing of mindset will be required of landlords and agents.
