This concerned a flood in May 1990 in a recently completed office building which was empty on completion, which resulted in ten weeks loss of rent. The liability for the damage was complex as Bovis who were employed under a management contract to design the building payed insurers General Accident but it was Bovis' public liability insurers Eagle Star that actually paid. The judge decided to take a straightforward view when he ruled that responsibility for the damage should be allocated by a four-way split between Bovis, Crown House, SFP and WPP.
