If the payment terms are in doubt, serve a notice - 2001 - Construction News (6743) 22 November 2001, 32(1) .

Considers the Construction Act 1996 s110 and s111 which give requirements in the event of a party wishing to withhold payment of a sum due under a construction contract. Discusses the actions needed if a payer disagrees with the amount the payee is asking for and also debates whether a notice is needed in the event of defence of abatement. Generally it advises that a notice should be served if there is any doubt.
