S failed to make an originating application seeking the grant of a new tenancy. A then entered into a lease of the premises until June 2006, but because of uncertainty of security of tenure acquired a long leasehold interest but at a less favourable position and was seeking damages against S. Damages of £315,000 were awarded; the judge agreed it was very difficult to reach a decision on the exact value.
