Aran Caterers Ltd v Stepien Lake Gilbert & Paling - 2001 - Estates Gazette [2001] 01 EG 76, 76-82(7) .

ChD 26 June 2001. Claimant (A) granted lease of term of shop premises proctected by the Landlord and Tenant Act 1954 Part II. A used the premises for the business of making sandwiches for sale in the shop. The landlord (S) served a notice on A and a counternotice was served in June 1997. S failed to make an originating application seeking the grant of a new tenancy. A then entered into a lease of the premises until June 2006, but because of uncertainty of security of tenure acquired a long leasehold interest but at a less favourable position and was seeking damages against S. Damages of £315,000 were awarded; the judge agreed it was very difficult to reach a decision on the exact value.
