CA 17 January 2002. "Ambrose v Kaye". The appellant (A) held a business tenancy of premises. When the tenant's lease expired, the landlord (K) tried to terminate the tenancy under the Landlord and Tenant Act 1954 Part II. A issued proceedings to apply for a new tenancy pursuant to s24(1) of the Act. The landlord opposed the application as he intended to occupy the premises himself. A preliminary hearing revealed the tenant A contended that K did not have a controlling interest in the company. K's wife transferred to him the majority of the shares in the company and K sought an adjournment to produce evidence of his controlling interest. The judge granted permission. At the later hearing, he found that K's objection to the grant of a new tenancy had been established. The tenant appealed. "Held", appeal dismissed.
