Notes how few cases end up in court and that by the time many are settled a considerable amount of time, money and energy has been wasted. Calls for adoption of ADR, arguing that mediation should become the primary focus in all cases which will mean a sweeping cultural change among the legal profession; as mediators they would need more listening skills and to discover what the parties really want. Urges judges to get tough and ask parties why no mediation has taken place. Urges English courts to follow the US example where judges can change roles from judge to mediator at the case management stage.
