"R (on the application of Lemon Land Ltd) v Hackney LBC" QBD, 11 May 2001, which examined the issue of whether Hackney LBC (H) could sell land at a lower price because the bidder offered economic benefit in the form of employment creation rather than a higher bidder, Lemon Land Ltd (L), that wanted the land for residential development. H proposed to sell development land (capable of both residential and employment-creation development), to the London Development Agency (LDA) who could pay a price reflecting the land's non-residential value but L made a higher offer close to the open-market value of the land for residential use. L applied for a judicial review of H's decision to sell the land to LDA without seeking the consent of the Secretary of State. Held: the application was allowed; L was entitled to the same benefits as offered LDA under the Local Government Act 1972 s123(2).
