In two recent judgments CA has confirmed that living in a damp flat, or being evicted for anti-social behaviour, does not infringe tenants' human rights. Judges dismissed appeals brought against Leeds and Sandwell councils, confirming that Human Rights Act 1998 does not compel councils to improve conditions in damp flats caused by a defect in design.
