QBD 16 January 2002. "Robinson v East Riding of Yorkshire Council". Claimant R owned a listed building and grounds that contained a large number of trees. R applied for permission to use part of its grounds for touring caravans. The council (E) refused permission and R appealed. Preparing for the appeal E carried out a survey and made a provisional tree preservation order (TPO). R objected to the TPO and sought judicial review of the Town and Country Planning (Tree) Regulations 1999 and challenged the TPO under the Town and Country Planning Act 1990 s288. "Held": the claim was dismissed on several grounds.
