"Ramsey and another v SoS " CA 1February 2002. R appealed against the Inspector's and judge's decisions upholding the local authority's refusal to grant a lawful development certificate for R's proposed use of land as an off-road race track on the grounds that the introduction of the vehicular use would change the use of the land from agricultural use to a permanent mixed use combining agricultural and vehicular use. CA held that vehicular use for a duration of more than 28 days was a temporary use permitted by the Town and Country Planning (General Permitted Development) Order 1995. Appeal allowed.
