"Bath and North East Somerset DC v Nicholson" ChD 22 February 2002. The claimant council B commenced possession proceedings against respondent N after many years of adverse possession. N, resisting the application on the grounds that he claimed adverse possesion, argued that the claim was time-barred under Limitation Act 1980 s15 and Sched 1 and that the 'without prejudice' letter of 1988 proposing lease terms was inadmissible. Held that B was entitled to possession as N had failed to prove adverse possession.
