The system of compulsory purchase and compensation is being looked at in order to make the system fairer, simpler and quicker. Currently compensation is assessed by the Pointe Gourde rule where the scheme is assumed not to exist. However, the recent case involving Fletcher Estates (Harlescott) Ltd, has introduced a new approach, which relies on the cancellation of the scheme at the relevant date and the reconstruction of a no-acquisition world for the value for compensation.
