Two cheers for commonhold

Two cheers for commonhold - 2002 - New Law Journal 152(7022) 8 March 2002, 338-340(3) .
Outlines the key provisions of the Commonhold and Leasehold Reform Bill, discussing the two distinct parts of the bill. Part 1 enacts commonhold tenure and may eventually replace the leasehold system for flats. Looks at the legislative history of commonhold and illustrates how a commonhold block of flats differs from a leasehold development. Commonhold is defined as a freehold with certain characteristics: owners of 'commonhold units' automatically become members of the 'commonhold association' (ChA) which will own the common parts; a 'Commonhold Community Statement' (CCS) regulates the units; and the ChA will decide the total 'commonhold assessment', the new service charge. Investigates each of these characteristics and explores how commonhold disputes will get resolved. Part 2 of the bill proposes substantial leasehold reforms in the meantime. Outlines proposals for the reform of collective enfranchisement, lease extensions, enfranchisement of leasehold houses, right to manage, services charges, variation of leases, the role of Leasehold Valuation Tribunals (LVTs) and forefeiture.
