"Well Barn Shoot Ltd v Shackleton" ChD, 12 April 2002. On the sale of the farm's freehold to the tenant (S) by the owner (W) who also owned the adjoining sporting estate, S insisted on having the right of way over track and sporting rights over farm. After S received planning permission to convert barns into dwellings, W sought access to Warren Field to the track. The claim was allowed as was S's counterclaim that no element of his proposed development infringed reserved sporting rights but subject to certain conditions.
