Discusses the case "Aubergine Enterprises Ltd v Lakewood International Ltd" on a buyer's right to rescind in absence of a formal licence to assign. It was decided that the buyer (A) had not been entitled to rescind its contract to purchase a lease from Lakewood (L) because of L's failure to obtain its landlord's formal licence to assign. It was held that a 'subject to licence' and 'in principle' consent were sufficient to satisfy standard conditions of sale.
