"R (on the application of Barron) v Surrey CC", CA 7 May 2002. Appeal by B against the judge's decision refusing B permission to pursue judicial review proceedings challenging the legality of the respondent council's scheme to charge householders for deed recognising right of way. Appeal allowed on the grounds that the settlement of B's private law claim to a right of way did not prevent B from pursuing a public law claim as part of a group of householders.
