In the first of two articles, the authors consider the effectiveness of common provisions found in lease guarantees.The main points that emerge are that a lease variation may discharge the guarantor and that the former guarantor's liability may be limited by the Landlord and Tenant (Covenants) Act 1995 s18. The next article will focus on guarantee provisions dealing with a tenant's insolvency.
