LT 22 November 2001. Claimant (W) sought compensation for the compulsory acquisition of land that formed part of a storage yard and access area to premises. Issues arising were: was claim barred under Limitation Act 1980?; was defendant (SW) estopped from relying on provisions of the 1980 Act?; did a binding agreement subject to satisfactory title exist for the acquisition of the land. "Held" claim dismissed as statute barred and S not estopped from using limitation defence. Although a compensation agreement from 1995 existed S had never agreed to waive the limitation period and both parties had proceeded on the basis that the period applied.
