LT 23 October 2001. Costs hearing on a reference to determine the compensation payable for the compulsory acquisition of the subject property following LT 9 August 2001 determination .Claimant's (H) former solicitors' valued property at £52 000. Respondent (B) had lodged a valuation of £31 750 but increased it to £42 000 at the trial. H denied knowledge of original figure put forward on his behalf and sought a valuation of £276 000. LT valued property at £47 500. "Held" although H's conduct had been unreasonable and his claim unrealistic, B was liable to pay H's costs following the general rule as a result of B's upward valuation during the trial and its failure to make an offer to settle.
