Ellis v Lambeth LBC

Ellis v Lambeth LBC - 2002 - Rating and Valuation Reporter [2002] RVR 94-96(3) .

CA 9 July 1999. Appeal by respondent (L) from earlier judgement that claimant (E) had acquired title to and was entitled to be registered as the proprietor of a squatted in Lambeth property which L had been trying to sell since 1993. E issued proceedings in 1997 to seek a declaration that he had become owner by adverse possession since 1983. L had sent two community charge registration forms to the property but neither form was completed. L contended that the non-completion of the forms was a representation of silence that the property was unoccupied and that E was estopped from asserting adverse possession. "Held" appeal dismissed as L had failed to show that its detriment was material and the immateriality negated any estoppel.
