TCC 21 March 2002. C refused to comply with an adjudicator's decision in favour of N in proceedings for an extension of time and loss and expense on the grounds that there were significant differences from the original claim in the factual justification for and quantification of loss and expense in the expert's report accompanying the referral notice and that this was effectively a different claim. The judge ruled in favour of C stating that a party must submit to adjudication the facts and arguments previously rehearsed between the party.
