"Hallam Land Management Ltd v UK Coal Mining Ltd and another" CA, 30 May 2002. First respondent vendor granted option to purchase land conditional upon making planning application for development of the property - a restored open-cast mining site. Appellant (H) wished to exercise option to purchase whilst the vendor maintained that this was not valid and transfered land to second repondent. H brought a claim for specific performance which the judge dismissed after finding there had been no planning application as required by the option agreement. The appeal was also dismissed.
