Reform of business tenancies legislation

Hewitson, R

Reform of business tenancies legislation - 2002 - Conveyancer and Property Lawyer (66) May/June 2002, 261-272(7) .

Examines government's proposals to reform Part II of the Landlord and Tenant Act 1954 which aim to streamline existing legislation rather than change the basic framework of the 1954 Act. Discusses the following areas: contracting out of security of tenure; extending the scope of the 1954 Act; s40 notices; renewal procedures; termination proceedings; termination of fixed term tenancies; time limits; interim rent; the term of a new lease; and compensation. Concludes that the proposals will improve and simplify the 1954 Act but queries whether they go far enough.
