Irascible by decibels

Wallace, K

Irascible by decibels - 2002 - Estates Gazette (0227) 6 July 2002, 134-135(2) .

Considers the issue of noise nuisance, questioning whether noisy neighbours are at fault or whether the complainants are being unrealistic. Explains how the Environmental Protection Act 1990 imposes a duty on local authorities to investigate complaints and highlights the factors that determine noise nuisance. Discusses cases concerning noise complaints including "Murdoch v Glacier Metal Company Ltd" (1998) , "Godfrey v Conwy County Borough Council" (2002), Shaftesbury Theatre having to close the West End musical "Umoja" following a noise abatement notice, and Bass being refused a liquor licence for an All Bar One bar following objections from nearby residents. Concludes that communicating, planning ahead and managing the site will help avoid complaints.
