CA has accepted in "Pumperninks of Piccadilly Ltd v Land Securities Ltd and others" the demolition or reconstruction of so-called "eggshell" premises. It found that a tenant cannot rely upon Landlord and Tenant Act 1954 s31A where, as result of landlord's works, a holding no longer exists. This section can apply however, where after this work, a holding needs limited reinstatement to allow reoccupation by tenant.
