CA 21 December 1995. C owned a shopping centre and leased 30% of the letting space to A, with a covenant by the tenants to keep the premises open for retail trade. On 19 May 1995 A closed and stripped the shop. C appealed against an earlier decision not to allow an order for specific performance against A to keep the premises open for the term of the lease. Appeal allowed.
