Considers case of "Co-operative Insurance Society Ltd v Henry Boot Scotland Ltd"[2002], highlighting the incorporation of ground condition reports into the contract and responsibility of contractors development of design. Concludes that design and build contractors may be held responsible for the completed design regardless that some parts of the design may have been prepared by the employers' consultants.
