[2002] EWCA Civ 671, 17 May 2002. The local planning authority resolved to grant a planning application for the redevelopment of Fulham Football Club's stadium without according objectors an oral hearing. Objectors relying on the right to a fair and public hearing in Human Rights Act 1998 Sched 1 Part 1 Art 6(1) requested that the SoS should call in the application but he refused. The objectors appealed against the refusal of an application for judicial review."Held" appeal dismissed. In the light of the HC's review jurisdiction objectors' Article 6 rights were not breached by the failure of the local planning authority to accord the objectors an oral hearing. SoS was not under a duty to exercise his Town and Country Planning Act 1990 s 77 power so as to prevent a violation of Art 6 of the 1998 Act. View judgment at www.courtservice.gov.uk/.
