Warns that while it may suit contractors to proceed with work while contracts are still being discussed, such a relaxed attitude may have serious consequences as was illustrated in the case of "Rickards and another v Jones" (2000). The house buying couple were told that the property would be sold with the benefit of National Housebuilders Council (NHBC) cover. However the Rickard's solicitor were in breach of their duty in failing to ensure that their new home was covered by a NHBC guarantee prior to completion of the purchase. Problems arose because the house was defective and the builder went into insolvency which meant that it has taken the Rickards six years to reach the stage where they may recover their losses.
