Considers two cases "Godwin v Swindon BC" (2001) and "Anderton v Clwyd CC" (2002), the central issue was whether the correct date of service of a claim form was the date when it was received of the date when it was deemed to have been served under the Civil Procedure Rules (CPR) r 6.7. The key points that emerge are that the date of service of a claim form is irrelevant, as the courts will consider the deemed date of service under the CPR. Claim forms can be deemed as being srved on a weekend or a bank holiday, and courts rarely retrospectively cure a defect in the service of a claim form.
