ChD 25 October 2002. Defendants (C) owned and operated an 18-bedroom hotel which offered river moorings for hotel guests. C sold the hotel as a going concern to claimant (P) for £700 000 and a further agreement was entered into whereby P obtained a option to buy the property belonging to the defendants for a further £200 000. The sale agreement and the subsequent conveyance of the hotel did not mention the mooring facility. P brought proceedings after C refused to allow hotel guests to use the river moorings and footbridge. P argued such use had been acquired by way of a grant to be implied by s62 of the Law of Property Act 1925. The claim was allowed as it was stated that a right to moor boats to a mooring post and the right to place a notice or sign were establised categories of easement. View judgment at www.bailii.org.
