Examines the law surrounding succession rights to residential tenancies following the death of a same-sex partner with reference to "Harrogate BC v Simpson" [1985] 27 HLR 205 and "Fitzpatrick v Sterling Housing Association Ltd" [2001] 1 AC 27. The Human Rights Act 1998 has forced the law to be revisited in the recent case "Mendoza v Ghaidan" [2002] EWCA Civ 1533 in which Mendoza was granted equal succession rights to a spouse or heterosexual partner on the death of his homosexual partner.
