Discusses the operation of pay when paid under the DOM/1 subcontract. Examines "Aqua Design and Play International Ltd and another v Kier Regional Ltd" which highlights that a pay when paid mechanism is not included in the published form of DOM/1. Despite that, the Housing Grants, Construction and Regeneration Act 1996 will allow such provisions in the event of the insolvency of the employer. The parties are then free to amend the subcontract to include a compliant pay when paid provision.
