In "Boscawen and others v Bajwa and others" and "Abbey National plc v Boscawen and others", CA 10 April 1995, it was held that where a building society lent money for the purchase of property with the result that a debt secured by a legal charge on the property was discharged, the building society was subrogated to the rights of the creditor under the charge.
