In "Dollar Land (Cumbernauld) Ltd v CIN Properties Ltd", Court of Session 16 February 1995, it was held that in the absence of other indications of a partnership, the common economic interest of the parties to a commercial venture was not sufficient to create a joint venture for the development and operation of part of the centre of a town.
