[2003] EHHC 475 (Ch), 14 January 2003. In June 1999 the claimants (M) purchased a property for £185 000 in reliance on the defendant surveyor's report. The report referred to minor structural movement in the property as long-standing. M were later told the risk of movement was greater than had been reported and they brought an action for negligence. Judgment was entered for M in April 2002 with damages to be assessed. M contended that the damages should reflect the difference between the purchase price and the immediate valuation. The defendant argued that the difference should be based upon the retrospective valuation. "Held" judgment was given for the defendant.
