QBD 29 July 2002. The claimant (S) brought a claim against the sixth defendant for noise nuisance after the kitchen and principal bathroom of the flat above were moved to be over S's bedroom, and marble and stone floors were fitted. "Held": the standard of comfort previously enjoyed was significant; the noise penetration was unreasonable, unacceptable and an actionable nuisance; the sixth defendant's reliance on the doctrine of laches failed as the doctrine had less force with a continuing nuisance.
