CA 14 May 2002. The appellant (K) sought to overturn an earlier ruling that DOM/1 cl32, which stated that a contractor is only obliged to pay subcontractors when paid by the employer, was not incorporated into the contract (see Abs64856 for discussion). "Held": the appeal was allowed on the grounds that it was clear that the agreement referred to the uncorrected version (See Abs66196).
